NANAM: The State Reform Party (STAR) has lashed out at Sabah Umno for attempting to divert attention away from the self-inflicted security problem that has occurred in the state during its watch.

STAR Sabah deputy chairman Daniel John Jambun said the attempt by Sabah Umno leaders to focus on opposition leader Tian Chua of PKR and his comments about the on-going security crisis in the state was absurd and an attempt to defect criticism.

He said that the call to ban Tian Chua from ever entering Sabah rather than imposing one on Umno leaders particularly former premier Dr Mahathir Mohamad, on whom the blame for the crisis can be placed, was the hight of hypocrisy.

“Mahathir and Umno leaders were in cahoots on “Projek IC” … to give out Malaysian documents to illegal immigrants in Sabah. They are the ones who should be barred,” Jambun said.
A series of police reports have made against Tian Chua for his earlier statement that the Lahad Datu incident was all of Umno’s doing.

Jambun said the hue and cry by Umno supporters lodging police reports and calling for Tian Chua to be barred from entering Sabah is a concerted effort by the ruling party to divert attention from allegations that a whole Umno branch in Lahad Datu had been compromised by the crisis.
Allegations have been made that several of those involved in the Kg Tanduo takeover by a band of Filipino mercenaries allied to the self-proclaimed Sultan of Sulu Jamalul Karim III are Umno members.

The brutal slaughter of eight Malaysian policemen by the mercenaries has left Umno leaders wringing their hands in distress.

Jambun, STAR chairman Jeffrey Kitingan’s outspoken deputy said, Umno leaders were squirming following the raid by the armed Filipino group especially after Chief Minister Musa Aman had time and again over the years assured that the east coast of the state is secure.

“Tian Chua’s unfavourable comment against Umno on the Sulu gunmen in Sabah would of course infuriate some Umno members, but look at the real issue at hand and who contributed to the whole problems linked to these illegal immigrants,” said Jambun in a statement here.
He said it was former premier Mahathir and his fellow Umno leaders, including current premier Najib Tun Razak, who put in place a scheme to grants Malaysian citizenship to hundreds of thousands of illegal immigrants from the Philippines.

Pakatan Rakyat (PR) has officially excluded Sabah Progressive Party (SAPP) from seat negotiations on Sabah’s opposition front, PKR’s Azmin Ali has confirmed, insisting the party’s demands are too unreasonable to accommodate.
The PKR deputy president told The Malaysian Insider that on the state-level, PR and its new Sabah allies — Angkatan Perubahan Sabah (APS) and Pertubuhan Pakatan Perubahan Sabah (PPPS) — have nearly agreed on a seat-sharing formula.
“There are just a few more overlapping seats. But we are now asking the PR presidential council to guide us in determining which seats should be contested by which party,” Azmin (picture) said when contacted here, adding that the matter was raised at Wednesday’s political bureau meeting.
But the Gombak MP, who has been leading seat talks with APS and PPPS, would not reveal PR’s seat-sharing formula with the two Sabah-based movements for strategic reasons.
APS is led by Tuaran MP Datuk Seri Wilfred Mojilip Bumburing, formerly the deputy president of Barisan Nasional’s (BN) United Pasokmomogun Kadazandusun Murut Organisation (UPKO), while PPPS is led by Beaufort MP and former Umno supreme council member Datuk Seri Lajim Ukin.
“But SAPP is completely out of the list, out of our formula. I am not blaming them for anything, simply that their demands are unreasonable,” Azmin confirmed.
SAPP, a nearly two-decade-old party led by former Sabah chief minister Datuk Yong Teck Lee, had earlier agreed to collaborate with PR in Election 2013 to topple BN from its east Malaysian fortress, but has been insisting that local parties must contest the lion’s share of the 60 seats in the state’s legislative assembly.
Yong said the peninsula-based PR can contest the majority of Sabah’s 25 federal seats to help its bid for Putrajaya but maintained that administrative power over the state must stay in the hands of parties with roots in Sabah.
He said that this would be in keeping with the state’s right to autonomy as enshrined in the 1963 Malaysia Agreement.
But Azmin told The Malaysian Insider that Yong’s demand for 40 or even half the state’s 60 seats was unreasonable.
He pointed out that when SAPP contested under BN in Election 2008, the party had only won two seats in Parliament and two in the state legislature. SAPP officially withdrew from BN in September 2008 and became an independent party.
“But they want 40 seats now? Then what is left for the rest of the opposition parties in Pakatan, in APS and PPPS?” Azmin said.

ustice for Altantuya: PM, AG must respond December 14, 2012

Isn't Najib, as head of the government, interested to know what actually happened, more so given the manner in which the murder was executed? asks DAP MP Gobind Singh.

Malaysia will forever remain in a dark cloud over the killing of Mongolian Altantuya Shaariibuu because of the failure of our criminal justice system to secure complete justice for her.
We have failed until now to explain why Altantuya was killed and more importantly who directed her killing.

The recent claims by Deepak Jaikishan surrounding the making of a statutory declaration has added more fuel into a fire which just cannot seem to be put out.The Attorney-General, Abdul Gani Patail, should respond to the allegations made by Deepak that “justice has not yet been done ” in the case involving Altantuya.

Deepak was earlier reported as saying: “Whoever actually killed her, who actually instructed her killing, should be responsible. They must take the responsibility.”This question has been asked time and again. The AG should tell us, who ordered the killing and why? This is the most important aspect of the case which has not been answered.

This angle ought to have been probed further during the trial of those who were charged with her murder.It is basic in all cases like this that motive is established. The prosecution owes the family of the deceased and the general public a duty here.

The truth must prevail
It is also surprising to note the prime minister’s silence on this matter.The prime minister has in past cases involving suspicious deaths, recognised the need for full ‘no stone unturned’ inquiries so as to get to the truth and to find justice and closure for the deceased and the families of the deceased.
Why is it different with Altantuya? Why are we not pressing for answers to these most important aspects of the case?Isn’t the prime minister as head of the government interested to know what actually happened more so given the manner in which the murder was executed?

It is said that “Justice must not only be done, it must be seen to be done”.
I challenge the prime minister to direct a full inquiry into these aspects of this case. We must get to the truth. The truth must prevail.

With the election looming, the prime minister cannot afford to have this problem hovering over his head.If he feels there is no need for further inquiry, and that the earlier investigations have answered all questions, then he should tell us, what does the investigation reveal? Who ordered the killing of Altantuya and why?

Kenapa Najib takut berbahas di Parlimen? (Oleh Dr Afif Bahardin)



PEMBENTANGAN  Belanjawan adalah merupakan salah satu sesi Parlimen yang mendapat liputan meluas dan perhatian yang lebih dari biasa; baik dari ahli politik, penganalisa politik, ahli ekonomi, ahli akademik, ahli perniagaan, pengamal media, kakitangan kerajaan, mahasiswa, pengusaha kecil, warga swasta, suri rumah bahkan seluruh rakyat yang peka akan situasi di sekelilingnya.

 Maka, lumrahnya sesi perbahasan Parlimen untuk satu–satu Belanjawan yang dibentangkan–sama peri pentingnya. Perbahasan Belanjawan 2013, menjadi sesi Parlimen terpenting menjelang Pilihan Raya Umum ke 13.  Lebih penting kerana PilihanRaya ini menjadi penentu hala tuju masa depan negara ini; mengekalkan regim lama Barisan Nasional atau menabalkan kerajaan baru di Putrajaya yang dipimpin Pakatan Rakyat.

Bermula dengan pembentangan Belanjawan pada Jumaat lepas oleh Menteri Kewangan, Datuk Seri Najib Razak, yang juga Perdana Menteri Malaysia, sesi perbahasan menyusul dengan dimulakan Ketua Pembangkang, Datuk Seri Anwar Ibrahim. Mungkin Setiausaha Politik Menteri Kewangan dan kebanyakan menteri kabinet lupa untuk mengingatkan majikan mereka bahawa tanggungjawab mereka tidak terhenti hanya pada membentangkan belanjawan.

Sebagai Perdana Menteri yang tanpa segan berdegar–degar menggelarkan Malaysia sebagai “world’s best democracy” – harus malu apabila mengambil sikap membentangkan belanjawan, memilih untuk tidak hadir sesi perbahasan, sebaliknya hanya menyokong untuk diluluskan sahaja.

 Kerajaan autokratik
 Ini bukanlah tradisi demokrasi, tetapi amalan sebuah kerajaan yang autokratik. Malang buat Malaysia memiliki Perdana Menteri yang langsung tidak mahu berdepan dengan perbahasan bukan hanya dari ahli Parlimen Pakatan Rakyat, bahkan dari ahli Parlimen Barisan Nasional sendiri. Sebaliknya mewakilkan ahli yang bukan dari barisan kabinet pun untuk menjawab bagi pihak kerajaan. Memalukan. Perdana Menteri pada sesi pembentangan Belanjawan, di hadapan jutaan rakyat Malaysia telah memilih untuk menyerang Pakatan Rakyat tanpa sebarang ruang untuk mencelah (kerana peraturan mesyuarat Dewan Rakyat).

Beliau kelihatan puas dan bangga dapat berbuat begitu. Namun, ketidakhadiran beliau pada sesi perbahasan, membuktikan betapa Perdana Menteri lebih mementingkan ego politik beliau daripada kepentingan rakyat terbanyak. Perdana Menteri secara tidak langsung menunjukkan beliau tidak mahu mendengar cadangan atau kritikan pembangkang yang dipilih rakyat secara demokratik, sebaliknya memilih untuk mentadbir negara secara autokratik. Sekali lagi Datuk Seri Najib Razak menunjukkan sikap pemerintahan kuku besi yang mirip ala pemerintahan seorang diktator.

 Amalan Westminster
 Sistem demokrasi negara ini – demokrasi berparlimen – yang diwarisi dari British ini merupakan warisan sistem Westminster. Kita punya dua dewan yang mulia – Dewan Rakyat dan Dewan Negara. Yang Di Pertuan Agong pula adalah elemen ketiga dalam sistem Parlimen negara. Namun ada perbezaan besar yang sangat menarik dapat kita lihat daripada apa yang terjadi dalam Dewan Rakyat hari ini.

Di House of Common di London, Perdana Menteri, bertanggungjawab untuk hadir ke satu sesi yang dinamakan Questions to the Prime Minister (lebih dikenali sebagai Prime Minister’s Questions atau PMQs).  Sesi PMQs secara tradisinya sejak 1997 (amalan ini diwarisi dan berubah mengikut peredaran zaman sejak kurun ke 17), dijalankan pada setiap Rabu ketika Parlimen bersidang.
Sesi ini membolehkan mana – mana ahli Parlimen, tanpa perlu mengikut aturan mesyuarat, untuk menanyakan soalan terus kepada Perdana Menteri dan beliau (baca : Perdana Menteri) akan menjawabnya terus di dalam sesi khas ini.  Perdana Menteri bukan sahaja berdepan dengan soalan dari ahli parlimen kerajaan, tetapi lebih penting berdepan dengan soalan dan bidasan dari pimpinan dan ahli Parlimen pembangkang.

Sesi ini sentiasa mendapat sambutan hangat dengan kehadiran penuh di ruang awam di Houses Of Parliament. Selain itu sesi ini juga di siarkan secara langsung kepada rakyat British untuk mereka menyaksikan kebijaksanaan wakil rakyat yang telah mereka pilih berbalas hujah.  Sesi begini menjadi kayu pengukur kepada kemampuan kerajaan mahupun pembangkang untuk pertahan dan mengkritik kebijakan yang telah mereka utarakan.

Malangnya di Malaysia – kita memiliki Perdana Menteri yang bukan hanya takut berdebat dengan Ketua Pembangkang di luar Dewan Rakyat, bahkan untuk berbahas mempertahankan Belanjawan yang beliau bentangkan sendiri pun beliau tidak sanggup. Dimanakah sikap tanggungjawab beliau sebagai Perdana Menteri dan juga Menteri Kewangan? Inikah amalan yang kita laungkan “world’s best democracy”? Bagaimana pula dengan slogan “Rakyat Didahulukan, Pencapaian Diutamakan”? Lebih menghairankan, apakah sebabnya Perdana Menteri begitu takut untuk berdepan dengan Ketua Pembangkang walau di dalam Dewan Rakyat yang majoritinya dikuasai Barisan Nasional?

Probe RM40m ‘donation’, Bank Negara told



PKR today lodged a report with Bank Negara Malaysia (BNM), saying that the central bank has a strong basis to initiate investigations into the RM40 million scandal which “goes all the way up to the prime minister”.

PKR strategy director Rafizi Ramli handed a statement to BNM’s communications officer Zoe Rai, in which he suggested several Sections under the Anti-Money Laundering Act 2011 that could be applied.

He said that the powerful legislation talked about how it was incumbent on a person to report about receiving money even if it was merely deemed “suspicious”. “This law is all encompassing, it doesn’t matter if you had the intention or whether you knew. “When Prime Minister Najib Tun Razak announced that the money was for Umno, it meant Umno was automatically guilty [under anti-money laundering laws] because it did not take reasonable steps to make sure it is not illicit funds,” alleged Rafizi.

“This is not just about [Sabah Chief Minister] Musa Aman, this is going all the way up to Najib, because as the number one in Umno, it was his duty,” he added. Other individuals who should be investigated, he said, included Musa, Minister in the Prime Minister’s Department Nazri Abdul Aziz and any other leader who had knowledge about this transaction but failed to report to BNM.

Rafizi said BNM should also find out about the Umno leader “X” as mentioned by Tuaran MP Wilfred Bumburing to have received the money into the personal account. He said that BNM could look at Section 3(1), 14(b), and 16(3) of the Act. He said the legislation stated that if a person did not take reasonable measures to ascertain the source of money he receives, and it was subsequently found to be illegal, that person had automatically breached anti-money laundering laws. He added that the Act also states that it was also the banks’ responsibility to report such suspicious transactions to BNM, said Rafizi.

“It is not enough for BNM to be satisfied with the short explanation of Najib and Nazri that the money was a political donation,” he said. Rafizi said that the Act also required the authorities to act when a proxy or frontman was used in these fund transfers.

The PKR leader also quoted a BNM circular called ECM4 that any transactions outside of the country above RM200,001 must be declared to BNM.

Report lodged in Sabah as well
Meanwhile, PKR-friendly NGO Jingga 13 lodged a similar report in Kota Kinabalu with the Sabah BNM branch.

According to the NGO’s coordinator Fariz Musa, the branch initially refused to accept their report and only after repeated attempts and instructions from BNM in Kuala Lumpur, was the report allowed.

Musa was hit by the scandal when Michael Chia, a businessman linked to the chief minister, was reportedly detained at an airport by Hong Kong authorities in 2008 with RM40 million worth of cash on him. 

Recently, Nazri told Parliament that the money was a political fund meant for Sabah Umno and Hong Kong’s Independent Commission Against Corruption (ICAC) had cleared Musa of any wrongdoings.
In a twist, Nazri later claimed Chia was never arrested by ICAC.

Nazri further said the RM40 million seized from Chia and frozen was wired into an account and was not in the businessman’s possession as claimed by the opposition and reported in the media. Yesterday, Bumburing claimed that the RM40 million “political donation” to Sabah Umno was being held in a personal account of an Umno leader. He did not name the person. It was reported that Chia told ICAC that the money was supposedly for Musa.

Sistem Demokrasi Berparlimen

Salah satu syarat sistem Demokrasi Berparlimen adalah pembahagian kuasa kepada tiga bahagian di dalam pemerintahan, iaitu Perundangan, Kehakiman dan Pentadbiran atau Eksekutif.

Malaysia juga merupakan sebuah negara yang mengamalkan sistem Demokrasi berasaskan kepada sistem Persekutuan. Sehubungan dengan itu, ia bermakna negeri-negeri Perlis, Kedah, Pulau Pinang, Perak , Selangor, Negeri Sembilan, Melaka, Johor, Pahang, Terengganu, Kelantan, Sarawak dan Sabah telah bersetuju dengan konsep penubuhan Negara Malaysia.

Setiap negeri yang terbabit telah menyerahkan sebahagian kuasa masing-masing, seperti kewangan, pertahanan, pelajaran, luar negara dan lain-lain lagi seperti mana yang telah tercatat di dalam Perlembagaan Malaysia yang di tadbir oleh Kerajaan Pusat. Ada perkara-perkara yang dijadikan kuasa negeri dan negeri akan mentadbirkan kuasa.
